WHAT IS ELECTRONIC HOME MONITORING?

The Stutsman County Correctional Center (SCCC) Electronic Home Monitoring (EHM) program is a community-based alternative sanction used by the courts in lieu of incarceration for low-risk offenders. Offenders serving sentences on EHM are monitored continuously and held accountable for their actions and whereabouts.

Participation is the EHM program is a privilege and the SCCC retains the right to terminate or deny program participants.

REPORTING

Participants ordered to serve a sentence on EHM must report to the SCCC located on the 2nd floor at 205 6th Street Southeast, Jamestown on the date and time specified by the court.  Only the sentencing judge may change report date.

PROGRAM REQUIREMENTS

Program Participants must:

  • Have a verifiable address and be able to stay at that residence.
  • Have access to a telephone or cell phone 24 hours a day.
  • Pass a UA and Alco scan.
  • Have NO pending charges.
  • Have NO warrants.
  • Be employed prior to the start of their sentence (if approved for work release).
  • Report to the SCCC in accordance to their court order.
 FEES

Participants are required to pay for the entire sentence up front. The rate is $13.00 per day, plus a $50.00 hook-up/disconnect fee.

The $50.00 hook-up/disconnect fee is required to place an order for an EHM bracelet.  If a participant is not placed on the EHM program for cause, such as failure to report to SCCC when scheduled or has a positive UA or Alco scan.  The hook-up/disconnect fee will be forfeited and the participant will be required to pay the cost of the tests ($15.00 for UA and $1.00 for Alco scan).

MONITORING

Participants are monitored electronically 24 hours a day, seven days a week through the use of proximity monitoring equipment (ankle bracelet) to ensure the location of participants. Participants may be checked at their place of employment and residence by SCCC staff or any other law enforcement officers at random times.

EHM WITH WORK RELEASE

Participants may only have one job while on the EHM program. Employment will be verified prior to being place on the program.  Participant’s employer must be registered to conduct business in ND. If the participant is self –employed they must be licensed with ND, and be able to provide a copy of the previous years filed tax records indicating their self-employment status.  EHM participants are not permitted to be employed by or employ another participant on the EHM program.

Participant work schedules are to be kept up weekly and will be verified by the Program Sergeant.  It is the participant’s responsibility to inform the Program Sergeant of any schedule changes and ensure the schedule is correct. Participants will not be allowed to work more than 10 hours a day 6 days a week to include 30 minute travel time to and from place of employment.  Participants will not work on Sundays.  Participants are to remain at their place of employment unless approval to leave is granted by the Program Sergeant.  In the event a participant leaves their place of employment without prior approval from the Program Sergeant, they may be terminated from the program.

If a participant is laid-off or terminated from their employment, the participant must contact the Program Sergeant immediately. Layoffs will be verified by the Program Sergeant prior to a job search being arranged.  If a participant is terminated from their employment they will be terminated from the EHM program and will serve remainder of sentence at the SCCC.

COURT ORDERED TREATMENT

Participants ordered by the court to attend treatment shall provide a treatment schedule to the Program Sergeant which will be verified before attendance is approved.  AA, NA, or other meetings must be approved by the Program Sergeant.

EHM RULES

Program participants will be held to a high standard and treated as such. The EHM rules will be enforced and any violations of the EHM rules may result in a participant’s immediate termination from the program.

  • A participant’s residence is required to be in Stutsman County.
  • A participant may not be employed at an establishment that primarily sells alcohol, i.e. bars and liquor stores.
  • Participants are not permitted to serve alcohol at their place of employment to include but not limited to restaurants.
  • Participants with a job that may have different work sites are responsible to notify the Program Sergeant of any job site changes.

A program participant may be terminated from the EHM program in the event the participant is charged with a crime or receives a criminal warrant for their arrest while on the EHM program.  If a participant is ordered to report to the SCCC for any reason and refuses or fails to do so, they may be terminated from the program.

No illegal drugs or alcohol are allowed in the participant’s residence or possession while on the EHM program. The participant’s residence is subject to being searched by SCCC staff or law enforcement officers at any time while on the EHM program. In the event illegal drugs or alcohol are found in a participant’s residence or the participant is in possession of illegal drugs or alcohol, the participant may be terminated from the program and/or charged accordingly.  At any time participants may be required to submit to a UA test or an Alco scan. In the event either test is Positive, the participant may be terminated from the program. Refusal to submit to a test will be documented as a positive test and the participants may be terminated from the program.

Any damage done to the EHM equipment provided to a participant will result in criminal charges and the participant may be termination from the EHM program.

Participants shall remain inside the confines of their residence unless approval to leave is granted by the Program Sergeant.

Participants may not possess firearms or weapons at any time while on the EHM program.

Participants will receive 1 hour per week on a scheduled day, time, and location to purchase groceries.

Participants are encouraged to contact the EHM Program Sergeant regarding any problem. This would be defined as hospital needs, calling in sick to work, equipment problems, weather delays, and any other emergencies. However if this becomes a problem a participant may be terminated from the program.

Participants must make other arrangements for all family events, to include kid’s activities.

Participants are required to read and sign an EHM Agreement which outlines the rules and regulations of the program.  The participant’s signature on the EHM agreement constitutes understanding of, and willingness to comply with all program rules and regulations.
